These terms explain the rules for using our website and the basics of working with us. Your signed project agreement covers the details of your court. Please read both carefully.
Agreement to These Terms
These Terms & Conditions (“Terms”) govern your use of 365customcourts.com and the programs and promotions offered on it. “365 Custom Courts,” “we,” “us” and “our” mean 365 Custom Courts, a Curate Construction brand, located at 749 Port America #600, Grapevine, TX 76051. By using our website, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the website.
Our website is intended for adults who can enter into contracts. If you use it for a business or property association, you confirm you’re authorized to act for it.
Using Our Website
You may use our website to learn about our services and to contact us. Please don’t:
- Submit false information, or someone else’s information without their permission.
- Send spam, automated or bulk submissions, or anything unlawful, harmful or offensive.
- Copy, scrape or reuse our content, photos or designs without our written permission.
- Try to access accounts, systems or data you’re not authorized to use, or disrupt the website.
- Upload viruses or malicious code, or try to get around security or usage limits.
We may block access or remove submissions that break these rules.
Website Content, Photos & Pricing
We work to keep our website accurate, but its content is general information, not an offer or a guarantee. Specifications, materials, colors, features and availability can change, and errors can happen.
- Prices. Prices shown with a plus sign (for example, “$45,000+”) are typical starting prices. Your price depends on your site, court size, surface, features, permits and other choices, and is set only in your written estimate and signed agreement.
- Photos. Photos show completed courts by 365 Custom Courts or our parent company, Curate Construction Group. Some show optional features or upgrades at additional cost. Results vary by property.
- Statistics and ratings reflect our records or third-party ratings at the time they were posted.
Consultations, Estimates & 3D Renderings
Consultations and 3D renderings are free and don’t obligate you to buy anything. Estimates are based on the information available at the time and are valid for the period stated on them. Final pricing may change if site conditions, measurements, permit or HOA requirements, or your selections change.
3D renderings are design illustrations. Actual colors, materials, lighting, landscaping and surroundings will differ, and the rendering is not part of your agreement unless the agreement says so. Scheduling a consultation does not reserve a construction date.
Project Agreements
Every court we build is covered by a separate written agreement that you sign. That agreement controls your project’s scope, price, payment schedule, timeline, warranty, change orders and dispute process, along with the notices and disclosures Texas law requires. If anything on this website conflicts with your signed agreement, your agreement controls.
Unless your agreement says otherwise, you’re responsible for confirming property lines, easements, HOA approvals and access to the work area. Weather, permitting, material availability and site conditions can affect timelines.
Your Right to Cancel
If you sign a purchase agreement at your home, or anywhere other than our place of business, you generally may cancel it without penalty or obligation within three business days after you sign. This right comes from the Federal Trade Commission’s Cooling-Off Rule and the Texas home solicitation law (Texas Business and Commerce Code, Chapter 601). Your agreement will include a notice of cancellation that explains how to cancel. If you cancel in time, we will refund any payment within the period the law requires.
Your agreement may give you other cancellation rights. Nothing in these Terms limits them.
Financing
Financing is offered by independent lenders, not by 365 Custom Courts. We are not a lender and do not make credit decisions. Financing is available to qualified applicants; each lender determines eligibility, rates and final terms, and approval is not guaranteed. You apply on the lender’s own website, under its terms and privacy policy. Financing details on our website are summaries and may change; your loan documents control.
Promotions & Promo Codes
Unless a promotion states otherwise:
- Promo codes and offers must be provided before you sign your purchase agreement.
- One promotion applies per project. Promotions can’t be combined unless we approve it in writing.
- Offers have no cash value, can’t be transferred or exchanged, and don’t apply to past purchases.
- Offers may expire, and we may change or end a promotion at any time, without affecting signed agreements.
- Offers are void where prohibited.
Our Customer Referral Program has its own terms, shown below.
Calls & Emails
When you request a consultation, you ask us to contact you about your request by phone or email using the information you provide. You can ask us to stop contacting you at any time by telling us on a call, replying to an email or emailing info@365customcourts.com. Calls to tracking numbers shown on our website are measured as described in our Privacy Policy.
Text Message Terms
365 Custom Courts text messages. If you agree to receive text messages from us, we will send texts about your consultation request, scheduling, appointment reminders and project updates and, if you agreed to them, occasional offers.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to stop receiving texts at any time. We will confirm your opt-out, and you won’t receive more texts unless you opt in again. Reply HELP for help, or call (469) 908-4689.
- Agreeing to receive texts is not a condition of any purchase.
- Mobile carriers are not liable for delayed or undelivered messages.
- If you change or give up your mobile number, please tell us so we don’t text the new owner of that number.
We will not share or sell your mobile number or text messaging consent with third parties for their marketing. See our Privacy Policy.
Intellectual Property
Our website, including its text, photos, videos, renderings, designs, logos and the 365 Custom Courts and Curate Construction names, is owned by us, our parent company or our licensors and is protected by copyright, trademark and other laws. You may view and share links to our pages for personal, non-commercial purposes. Any other use requires our written permission.
Photos & Information You Send Us
When you send us information, photos, measurements or ideas, you confirm you have the right to share them, and you let us use them to respond to you and to design and build your project. We will use photos of your property or your name in marketing only with your permission. Please don’t send confidential information you don’t want us to use.
Third-Party Links & Services
Our website links to and includes services from other companies, such as our scheduling calendar, lender applications, embedded videos, maps, social media and our parent company’s website. We don’t control those services and aren’t responsible for their content, availability or practices. Their own terms and privacy policies apply.
Website Disclaimer
Our website is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties about the website, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don’t promise the website will always be available, accurate or error-free.
This disclaimer applies to the website only. Warranties for your court are stated in your signed agreement. Nothing in these Terms limits any warranty or right you have under your agreement or under laws that can’t be waived, including the Texas Deceptive Trade Practices–Consumer Protection Act.
Limitation of Liability
To the fullest extent the law allows, 365 Custom Courts and its parent company, owners, employees and partners will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, our website. Our total liability for any claim about the website is limited to one hundred dollars ($100).
This section does not apply to your project, which is governed by your signed agreement, or to liability that the law does not allow us to limit.
Indemnification
If you misuse our website or break these Terms, you agree to cover the reasonable losses and costs, including attorneys’ fees, that we incur because of it, to the extent the law allows.
Governing Law & Venue
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law rules. Any dispute about these Terms or our website will be resolved in the state or federal courts located in Tarrant County, Texas, unless the law requires otherwise. Disputes about a project are handled as described in that project’s agreement.
Accessibility
We want everyone to be able to use our website. If you have trouble using any part of it, call us at (469) 908-4689 or email info@365customcourts.com, and we’ll help you and work to fix the problem.
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms here with a new “Last updated” date. Changes apply from that date and don’t change agreements you’ve already signed. Program terms, such as the Customer Referral Program terms, change only as those terms describe.
General Terms
If any part of these Terms can’t be enforced, the rest stays in effect. Our not enforcing a provision isn’t a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a business transfer. These Terms, our Privacy Policy and any program terms are the whole agreement about your use of the website. Your signed project agreement governs your project.
